In Skinner v. Skinner the father paying support moved to reduce his support because he had an illness that prevented him from working consistently.
The father had to prove that his illness caused a “material change in circumstances”. The father lead evidence that he had mental health issues and was improperly diagnosed in 2015. It wasn’t until he received a proper diagnoses and treatment that he was able to recover. However, once he recovered, the father could not rely upon his illness to justify a reduction in his income.
